SENATE AMENDMENT 11, TO ASSEMBLY BILL 40

June 20, 2013 - Offered by Senators Erpenbach, Wirch, Risser, T. Cullen, Miller, Lehman, Harris, Hansen and C. Larson.

AB40-SA11,1,2 At the locations indicated, amend the bill, as shown by assembly substitute amendment 1, as follows:

AB40-SA11,1,6 1. Page 213, line 15: increase the dollar amount for fiscal year 2013-14 by $171,000 and increase the dollar amount for fiscal year 2014-15 by $491,600 for the purpose of paying administrative costs of providing Medical Assistance benefits to certain adults with incomes up to 133 percent of the poverty line.

Page 213, line 17: decrease the dollar amount for fiscal year 2013-14 by $25,894,300 and decrease the dollar amount for fiscal year 2014-15 by $91,760,000 for the purpose of providing Medical Assistance benefits to certain adults with incomes up to 133 percent of the poverty line.

Page 214, line 5: increase the dollar amount for fiscal year 2013-14 by $315,600 and increase the dollar amount for fiscal year 2014-15 by $1,110,700 for the purpose of paying administrative costs of providing Medical Assistance benefits to certain adults with incomes up to 133 percent of the poverty line.

(4) (a) 4. or s. 49.45 (23), an adult who is under 65 years of age; who is not pregnant; who is not otherwise eligible for Medical Assistance under this paragraph or s. 49.46 (1); and whose income, as determined under the method described in 42 USC 1396a (e) (14), does not exceed 133 percent of the poverty line for a family the size of the individual's family.

AB40-SA11,1100h Section 1100h. 49.471 (4) (a) 8. of the statutes, as created by 2013 Wisconsin Act .... (this act), is repealed.".

AB40-SA11,3,6 " Section 1107k. 49.471 (4g) of the statutes is created to read:

AB40-SA11,3,14 49.471 (4g) Medicaid expansion federal medical assistance percentage. For services provided to individuals described under sub. (4) (a) 8., the department shall comply with all federal requirements to qualify for the highest available enhanced federal medical assistance percentage. The department shall submit any amendment to the state medical assistance plan, request for a waiver of federal Medicaid law, or other approval required by the federal government to provide services to the individuals described under sub. (4) (a) 8. and qualify for the highest available enhanced federal medical assistance percentage.

AB40-SA11,1107m Section 1107m. 49.471 (4g) of the statutes, as created by 2013 Wisconsin Act .... (this act), is repealed.".

AB40-SA11,3,18 12. Page 601, line 19: delete the material beginning with that line and ending with page 603, line 17.

AB40-SA11,3,20 13. Page 1385, line 20: after "(7) (c) of the statutes" insert ", the creation of section 49.471 (1) (cr), (4) (a) 8., and (4g) of the statutes".

AB40-SA11,3,21 14. Page 1385, line 21: after that line insert:

AB40-SA11,3,23 "(7m) Medical Assistance expansion sunset. The repeal of section 49.471 (1) (cr), (4) (a) 8., and (4g) of the statutes takes effect on January 1, 2017.".
