ASSEMBLY AMENDMENT 2, TO ASSEMBLY BILL 462

AB462-AA2,1,1 At the locations indicated, amend the bill as follows:

AB462-AA2,1,3 1. Page 2, line 8: delete lines 8 to 10 and substitute "explicit conduct is guilty of a Class A misdemeanor if all of the following apply:".

AB462-AA2,1,4 2. Page 2, line 10: after that line insert:

AB462-AA2,1,5 "1. The actor intended to cause the person represented emotional distress.

AB462-AA2,1,8 2. The person represented did suffer emotional distress as a result of the reproduction, distribution, exhibition, publication, transmission, or other dissemination of the representation.

AB462-AA2,1,11 3. The person represented consented to, or reasonably intended for, no one except the actor and the person himself or herself to capture, view, or possess the representation.

AB462-AA2,2,3 (am) The consent of the person represented to the capture of the representation or to the possession of the representation by the actor is not a defense to a violation of this subsection.".
