TO ASSEMBLY BILL 74

AB74-ASA1,1,3 1An Act to amend 20.455 (2) (kv); and to create 814.75 (8r), 814.76 (5m) and
2973.0455 of the statutes; relating to: creating a treatment and diversion
3surcharge and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB74-ASA1,1 4Section 1. 20.455 (2) (kv) of the statutes, as affected by 2013 Wisconsin Act 20,
5is amended to read:
AB74-ASA1,1,86 20.455 (2) (kv) Grants for substance abuse treatment programs for criminal
7offenders.
All moneys received under s. 961.41 (5) (c) 2. or 973.043 and under s.
8973.0455
for the purpose of making grants to counties under s. 165.95 (2).
AB74-ASA1,2 9Section 2. 814.75 (8r) of the statutes is created to read:
AB74-ASA1,1,1010 814.75 (8r) The treatment and diversion surcharge under s. 973.0455.
AB74-ASA1,3 11Section 3. 814.76 (5m) of the statutes is created to read:

1814.76 (5m) The treatment and diversion surcharge under s. 973.0455.
AB74-ASA1,4 2Section 4. 973.0455 of the statutes is created to read:
AB74-ASA1,2,6 3973.0455 Treatment and diversion surcharge. (1) If a court imposes a
4sentence or places a person on probation, the court shall impose a treatment and
5diversion surcharge. The surcharge is the total amount calculated by adding up, for
6each misdemeanor or felony count on which a conviction occurred, $20.
AB74-ASA1,2,10 7(2) After determining the amount due, the clerk of court shall collect and
8transmit the amount to the county treasurer under s. 59.40 (2) (m). The county
9treasurer shall then make payment to the secretary of administration under s. 59.25
10(3) (f) 2.
AB74-ASA1,2,12 11(3) The secretary of administration shall credit the surcharge to the
12appropriation account under s. 20.455 (2) (kv).
AB74-ASA1,5 13Section 5. Initial applicability.
AB74-ASA1,2,1514 (1) This act first applies to a person who is sentenced or placed on probation for
15an offense committed on the effective date of this subsection.
