SENATE AMENDMENT 1, TO SENATE BILL 351

SB351-SA1,1,1 At the locations indicated, amend the bill as follows:

SB351-SA1,1,2 1. Page 3, lines 1 and 9: before "pharmaceutical" insert "household".

SB351-SA1,1,5 2. Page 3, line 2: after "items." insert ""Drug disposal program" does not include a sharps collection station operated in compliance with rules promulgated by the department of natural resources.".

SB351-SA1,1,7 3. Page 3, line 3: delete the material beginning with "(d)" and ending with "drug." on line 6 and substitute:

SB351-SA1,1,11 "(d) 1. Except as provided under subd. 2., "household pharmaceutical item" means any of the following if lawfully possessed by an individual for the individual's own use, for the use of a member of the individual's household, or for the use of an animal owned by the individual or a member of the individual's household:

SB351-SA1,2,5 a. A drug, as defined in s. 450.01 (10); a prescription drug, as defined in s. 450.01 (20); or a controlled substance or controlled substance analog, if the drug, prescription drug, or controlled substance or controlled substance analog is located in or comes from a place where the individual, a member of the individual's household, an in-home hospice service, or an adult family home serving fewer than 5 adult members manages the use of the drug, prescription drug, or controlled substance or controlled substance analog.

SB351-SA1,2,10 b. A device, as defined in s. 450.01 (6), or an object used for administering a drug, if the device or object is located in or comes from a place where the individual, a member of the individual's household, an in-home hospice service, or an adult family home serving fewer than 5 adult members manages the use of the device or object.

SB351-SA1,2,11 2. "Household pharmaceutical item" does not include any of the following:

SB351-SA1,2,14 a. Any item that may be contaminated with antineoplastic chemotherapy drugs, including objects used to administer drugs, gloves, and other items that have come into contact with chemotherapy drugs.

SB351-SA1,2,15 b. Any item containing elemental mercury.".

SB351-SA1,2,17 4. Page 4, lines 1, 2, 3, 6, 20, 21 and 23: before "pharmaceutical" insert "household".

SB351-SA1,2,18 5. Page 5, lines 9, 11 and 12: before "pharmaceutical" insert "household".

SB351-SA1,2,19 6. Page 6, line 19: after that line insert:

SB351-SA1,2,22 "(d) Each person that operates a drug disposal program in this state shall, within 30 days after the drug disposal program begins operation, notify and provide all of the following information to the department of natural resources:

SB351-SA1,2,23 1. The location and hours of operation of the drug disposal program.

SB351-SA1,3,3 2. The name, address, telephone number, and 24-hour contact information for one or more persons in this state who are responsible for the operation of the program.

SB351-SA1,3,5 3. A description of the household pharmaceutical items the drug disposal program may receive.".
