SENATE AMENDMENT 7, TO ASSEMBLY BILL 554

AB554-SA7,1,1 At the locations indicated, amend the bill as follows:

AB554-SA7,1,4 1. Page 3, line 1: delete the material beginning with that line and ending with page 4, line 19, including the material inserted by assembly amendment 2, and substitute:

AB554-SA7,1,6 " Section 1m. 66.0817 (4) of the statutes is renumbered 66.0817 (4) (a) and amended to read:

AB554-SA7,2,4 66.0817 (4) (a) After Except as provided in par. (b), after the price and other terms are fixed under sub. (3), the proposal shall be submitted to the electors of the municipality. The notice of the referendum shall include a description of the plant and a summary of the preliminary agreement and of the price and terms as fixed by the department of transportation or public service commission. If a majority voting on the question votes for the sale or lease, or if a referendum is not required under par. (b), the board or council may consummate the sale or lease, upon the terms and at a price not less than fixed by the department of transportation or public service commission, with the proposed purchaser or lessee or any other with whom better terms approved by the department of transportation or public service commission can be made.

AB554-SA7,2m Section 2m. 66.0817 (4) (b) of the statutes is created to read:

AB554-SA7,2,13 66.0817 (4) (b) If the proposal is for the sale or lease of a public utility that furnishes water or sewer service to an investor-owned public utility, a referendum under par. (a) is required only if, within 60 days after the adoption of a resolution or ordinance under sub. (1), a petition conforming to the requirements of s. 8.40 requesting submission of the proposal to the municipality's electors, signed by a number of qualified electors equal to at least 10 percent of the votes cast in the municipality for governor at the last general election, is filed in the office of the municipal clerk.".

AB554-SA7,2,14 2. Page 5, line 9: delete lines 9 and 10 and substitute:

AB554-SA7,2,18 "(1m) The renumbering and amendment of section 66.0817 (4) of the statutes and the creation of section 66.0817 (4) (b) of the statutes first apply to proposals under preliminary agreements that are executed on the effective date of this subsection.".
