SB239-SSA2-SA8,1,1 At the locations indicated, amend the substitute amendment as follows:

SB239-SSA2-SA8,1,3 1. Page 1, line 3: after "well," insert "review of certain high capacity well approvals,".

SB239-SSA2-SA8,1,4 2. Page 3, line 10: after that line insert:

SB239-SSA2-SA8,1,5 " Section 2d. 281.34 (2d) of the statutes is created to read:

SB239-SSA2-SA8,2,2 281.34 (2d) Review of high capacity well approvals; change in quantity. The department shall review the approval of a high capacity well approved under this section or under s. 281.17 (1), 2001 stats., if the volume of water withdrawn from the well during any year is at least twice the average annual volume of water withdrawn from the well during the previous 5 years, or, if the well has been in operation for less than 5 years, at least twice the average annual volume of water withdrawn from the well during the years in which the well has been in operation. The department may modify the conditions of the approval, or rescind the approval.".

SB239-SSA2-SA8,2,4 " Section 3m. 281.34 (7) of the statutes is amended to read:

SB239-SSA2-SA8,2,10 281.34 (7) Modifying and rescinding approvals for high capacity wells. The approval of a high capacity well issued under this section or under s. 281.17 (1), 2001 stats., remains in effect unless the department modifies or rescinds the approval under sub. (2d) or modifies or rescinds the approval because the high capacity well or the use of the high capacity well is not in conformance with standards or conditions applicable to the approval of the high capacity well.".
