3“d. With regard to any type of construction, building, collocation, or
4encroachment permit required by a political subdivision that relates to a small
5wireless facility, if the state or a political subdivision fails to approve or deny a permit
6application under this section not later than 90 days after its receipt, the applicant
7may consider its permit application approved, provided, however, that if applicants
8collectively have submitted applications for 100 or more small wireless facilities that
9are pending review by the political subdivision at any one time, the political
10subdivision may take not more than 120 days to review newly submitted applications
11which are in excess of the 100 or more small wireless facilities under review at the
1time of submission, and the political subdivision shall notify the applicant of the
2extended review period at the time of submission.”.
