SENATE AMENDMENT 10, TO SENATE BILL 109

SB109-SA10,1,1 At the locations indicated, amend the bill as follows:

SB109-SA10,1,3 1. Page 2, line 4: after “professions" insert “and granting rule-making authority".

SB109-SA10,1,4 2. Page 9, line 1: delete lines 1 to 5 and substitute:

SB109-SA10,1,5 “ Section 45g. 454.08 (1) (ag) of the statutes is created to read:

SB109-SA10,1,8 454.08 (1) (ag) The examining board shall promulgate rules specifying the chemicals that may be used in the practice of cosmetology, aesthetics, electrology, or manicuring outside of a licensed establishment under par. (ar).

SB109-SA10,45r Section 45r. 454.08 (1) (ar) of the statutes is created to read:

SB109-SA10,1,11 454.08 (1) (ar) A person may practice cosmetology, aesthetics, electrology, or manicuring outside of a licensed establishment if all of the following apply:

SB109-SA10,1,13 1. The person owns, manages, is employed by, or is affiliated with an establishment that is licensed to provide that service under sub. (2).

SB109-SA10,2,3 2. The person obtains a mobile practice permit under s. 454.085 and displays that permit at the location where cosmetology, aesthetics, electrology, or manicuring is practiced.

SB109-SA10,2,6 3. The person displays the certificate furnished to the person under s. 454.06 (7) at the location where cosmetology, aesthetics, electrology, or manicuring is practiced.”.

SB109-SA10,2,8 4. Page 10, line 3: after that line insert:

SB109-SA10,2,9 “ Section 48m. 454.085 of the statutes is created to read:

SB109-SA10,2,12 454.085 Mobile practice permits. (1) No person may practice cosmetology, aesthetics, electrology, or manicuring outside of a licensed establishment unless the person is granted a permit under this section.

SB109-SA10,2,15 (2) An application for a permit under this section shall be submitted to the examining board on a form provided by the examining board and shall include an annual fee determined by the examining board.

SB109-SA10,2,17 (3) The examining board shall grant a permit under this section to each person who submits an application and pays the fee under sub. (2).

SB109-SA10,2,20 (4) A permit granted under this section is valid from the date on which the examining board grants the permit to the first December 31 following the date of issuance.”.

SB109-SA10,3,3 454.25 (1) (ag) The department shall promulgate rules specifying the chemicals that may be used in the practice of barbering outside of a licensed establishment under par. (ar).

SB109-SA10,66r Section 66r. 454.25 (1) (ar) of the statutes is created to read:

SB109-SA10,3,6 454.25 (1) (ar) A person may practice barbering outside of a licensed establishment if all of the following apply:

SB109-SA10,3,9 1. The person owns, manages, is employed by, or is affiliated with a barbering establishment licensed under sub. (2) or a cosmetology establishment licensed under s. 454.08 (2).

SB109-SA10,3,11 2. The person obtains a mobile practice permit under s. 454.255 and displays that permit at the location where barbering is practiced.

SB109-SA10,3,13 3. The person displays the certificate issued to the person under s. 454.23 (4) at the location where barbering is practiced.”.

SB109-SA10,3,20 454.255 Mobile practice permits. (1) No person may practice barbering outside of a licensed establishment unless the person is granted a permit under this section.
