SB427-SA1,1,2 21. Page 9, line 7: after that line insert:
SB427-SA1,1,4 3 Section 26j. 940.19 (6) (intro.) and (b) of the statutes are consolidated,
4renumbered 940.19 (6) and amended to read:
SB427-SA1,1,105 940.19 (6) Whoever intentionally causes bodily harm to another by conduct
6that creates a substantial risk of great bodily harm is guilty of a Class H felony. A
7rebuttable presumption of conduct creating a substantial risk of great bodily harm
8arises: (b) If if the person harmed has a physical disability, whether congenital or
9acquired by accident, injury or disease, that is discernible by an ordinary person
10viewing the physically disabled person, or that is actually known by the actor.
SB427-SA1,26m 11Section 26m. 940.19 (6) (a) of the statutes is repealed.”.
