TO ASSEMBLY BILL 314

AB314-ASA1,1,3 1An Act to amend 93.42 (5); and to create 13.94 (1) (ds), 20.115 (3) (b) and 93.425
2of the statutes; relating to: promoting the export of Wisconsin's agricultural
3and agribusiness products.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Agriculture, Trade and Consumer
Protection and the Wisconsin Economic Development Corporation to cooperate in
achieving certain objectives related to Wisconsin's export of agricultural products.
The bill requires DATCP to establish an agricultural exports program to
promote the export of Wisconsin's agricultural and agribusiness products.
Specifically, the bill requires DATCP's Center for International Agribusiness
Marketing and WEDC to cooperate to achieve the following export objectives by June
30, 2026:
1. Increase the value of Wisconsin's milk and other dairy product exports by at
least 25 percent over the value as of December 31, 2021.
2. Increase the value of Wisconsin's meat, including poultry and fish, and meat
product exports by at least 25 percent over the value as of December 31, 2021.
3. Increase the value of Wisconsin's crop and crop product exports by at least
25 percent over the value as of December 31, 2021.
The bill requires that DATCP expend $5,000,000 under the program, after
submitting a request to the Joint Committee on Finance for funding for the program.

Of that amount, the bill requires DATCP to ensure that $2,500,000 is devoted to
increasing the value of Wisconsin's milk and other dairy product exports, $1,250,000
is devoted to increasing the value of Wisconsin's meat exports, and $1,250,000 is
devoted to increasing the value of Wisconsin's crop exports, all as provided above.
Under the bill, DATCP may not expend more than a total of $1,000,000 under the
program in any fiscal year.
No later than December 31, 2021, DATCP and WEDC must jointly submit a
plan to the legislature for how DATCP and WEDC intend to achieve the export
objectives established in the bill. The plan must include a plan to award grants
totaling at least 15 percent of the moneys appropriated for the program to Wisconsin
exporters no later than December 31, 2022. Additionally, no later than June 30,
2024, DATCP and WEDC must jointly submit a report to the legislature that
describes in detail all progress made in achieving the export goals the bill establishes
for the program, as described above.
The bill requires DATCP to reallocate one full-time equivalent position to the
agricultural exports program created under the bill.
Finally, the bill requires the Legislative Audit Bureau to conduct a program
evaluation audit of the exports program and complete its audit report no later than
December 31, 2026.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

3agricultural exports program under s. 93.425. No later than December 31, 2026, the
4legislative audit bureau shall file a copy of each audit report under this paragraph
5with the distributees specified in par. (b).

AB314-ASA1,5 8Section 5. 93.425 of the statutes is created to read:
AB314-ASA1,3,11 993.425 Agricultural exports program. (1) The center for international
10agribusiness marketing shall establish and administer an agricultural exports
11program to promote the export of this state's agricultural and agribusiness products.
AB314-ASA1,3,14 12(2) The center for international agribusiness marketing shall cooperate with
13the Wisconsin Economic Development Corporation to achieve all of the following
14export objectives by June 30, 2026:
AB314-ASA1,3,1615 (a) Increase the value of this state's milk and other dairy product exports by
16at least 25 percent over the value as of December 31, 2021.
AB314-ASA1,3,1817 (b) Increase the value of this state's meat, including poultry and fish, and meat
18product exports by at least 25 percent over the value as of December 31, 2021.

1(c) Increase the value of this state's crop and crop product exports by at least
225 percent over the value as of December 31, 2021.
AB314-ASA1,4,8 3(3) Of the moneys appropriated under s. 20.115 (3) (b), the center for
4international agribusiness marketing shall ensure that $2,500,000 is expended for
5the objective specified in sub. (2) (a), $1,250,000 is expended for the objective
6specified in sub. (2) (b), and $1,250,000 is expended for the objective specified in sub.
7(2) (c). The center may not expend more than $1,000,000 under the program in any
8fiscal year.
AB314-ASA1,4,13 9(4) No later than June 30, 2024, the center for international agribusiness
10marketing and the Wisconsin Economic Development Corporation shall jointly
11submit a report to the appropriate standing committees of the legislature under s.
1213.172 (3) that describes in detail all progress made in achieving the goals specified
13in sub. (2) (a) to (c).
AB314-ASA1,6 14Section 6 . Nonstatutory provisions.
AB314-ASA1,4,2215 (1) Submission of plan. No later than December 31, 2021, the center for
16international agribusiness marketing and the Wisconsin Economic Development
17Corporation shall jointly submit to the chief clerk of each house of the legislature for
18distribution to the appropriate standing committees in the manner provided under
19s. 13.172 (3) a plan for how the center and the corporation intend to achieve the export
20objectives specified in s. 93.425 (2). The plan shall include a plan to grant at least
2115 percent of the moneys to be expended under s. 93.425, as provided in s. 93.425 (3),
22to exporters no later than December 31, 2022.
AB314-ASA1,5,423 (2) Program funding. No later than the 30th day after publication of the 2021
24biennial budget act, the center for international agribusiness marketing shall
25request under s. 13.101 (3) that the joint committee on finance supplement the

1appropriation under s. 20.115 (3) (b) with sufficient funds for the center to carry out
2the agricultural exports program under s. 93.425. The committee may supplement
3that appropriation for that purpose without finding that an emergency exists under
4s. 13.101 (3) (a) 1.
AB314-ASA1,5,135 (3) Position authorization. The department of agriculture, trade and
6consumer protection shall reallocate 1.0 GPR position, and any associated funding
7that may be available, to a position to be funded from the appropriation under s.
820.115 (3) (b) for the purpose of administering the agricultural exports program
9under s. 93.425. The department shall report to the joint committee on finance as
10to the position that is reallocated and the source of funding for that position. The
11department shall report in its 2023-25 biennial budget request the position
12reallocated under this subsection, and the reallocation shall be reflected in the final
13appropriation schedule in ch. 20.
