ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 73

AB73-AA1,1,1 At the locations indicated, amend the bill as follows:

AB73-AA1,1,3 1. Page 1, line 2: delete “and granting rule-making authority" and substitute “, granting rule-making authority, and providing a penalty".

AB73-AA1,1,4 2. Page 3, line 6: after that line insert:

AB73-AA1,1,7 “(4m) Penalties. (a) 1. Any person who violates sub. (1) shall be fined not less than $100 and not more than $1,000, for the first offense; and for each subsequent offense, fined not less than $500 and not more than $5,000.

AB73-AA1,1,11 2. Notwithstanding subd. 1. and s. 97.72, a person who sells or offers for sale food products at retail is not subject to a penalty for violating sub. (1) if the person does not engage in food processing, as defined in s. 97.29 (1) (g), of a food product that is labeled in violation of sub. (1).

AB73-AA1,2,3 (b) 1. Any person who violates sub. (2) shall be fined not less than $100 and not more than $1,000, for the first offense; and for each subsequent offense, fined not less than $500 and not more than $5,000.
