ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 230

AB230-AA1,1,1 At the locations indicated, amend the bill as follows:

AB230-AA1,1,2 1. Page 3, line 19: delete lines 19 and 20 and substitute:

AB230-AA1,1,5 “218.10 (1n) “Distributor” means a resident or nonresident who, in whole or in part, sells or distributes new recreational vehicles to recreational vehicle dealers or who maintains distributor representatives.”.

AB230-AA1,1,6 2. Page 4, line 4: delete “travel trailer" and substitute “recreational vehicle".

AB230-AA1,1,7 3. Page 5, line 17: delete “45" and substitute “46".

AB230-AA1,1,8 4. Page 5, line 18: delete “travel trailer" and substitute “ recreational vehicle".

AB230-AA1,1,9 5. Page 5, line 19: delete that line and substitute “vehicle, and travel trailer.”.

AB230-AA1,1,12 “ Section 18e. 218.11 (title) of the statutes is amended to read:

AB230-AA1,2,2 218.11 (title) Recreational vehicle dealers, manufacturers, and distributors regulated.

AB230-AA1,18g Section 18g. 218.11 (2) (e) of the statutes is created to read:

AB230-AA1,2,9 218.11 (2) (e) A recreational vehicle dealer or an applicant for a recreational vehicle dealer license shall provide and maintain in force a bond or irrevocable letter of credit of not less than $50,000. The bond or letter of credit shall be executed in the name of the department of transportation for the benefit of any person who sustains a loss because of an act of a recreational vehicle dealer that constitutes grounds for the suspension or revocation of a license under sub. (6).

AB230-AA1,18j Section 18j. 218.11 (4) of the statutes is created to read:

AB230-AA1,2,12 218.11 (4) (a) No manufacturer or distributor may engage in business as a manufacturer or distributor in this state without a license.

AB230-AA1,2,19 (b) No manufacturers' or distributors' recreational vehicles may be sold in this state unless either the manufacturer on direct dealerships of domestic vehicles or the distributor on indirect dealerships of either domestic or foreign vehicles are licensed under par. (a). The obtaining of a license under par. (a) shall conclusively establish that a manufacturer or distributor is doing business in this state and shall subject the licensee to all provisions of the Wisconsin statutes regulating manufacturers and distributors.

AB230-AA1,18m Section 18m. 218.11 (6) (o) of the statutes is created to read:

AB230-AA1,2,22 218.11 (6) (o) Being a dealer, manufacturer, or distributor that violates any provision of s. 218.161 to 218.167.

AB230-AA1,18w Section 18w. 218.15 of the statutes is amended to read:

AB230-AA1,3,2 218.15 Sale or lease of used recreational vehicles. In the sale or lease of any used recreational vehicle, the sales invoice or lease agreement shall contain the point of manufacture of the used recreational vehicle, and the name of the manufacturer and the name and address of the previous owner.”.

AB230-AA1,3,3 8. Page 21, line 6: delete lines 6 to 14.

AB230-AA1,3,4 9. Page 22, line 7: delete “45" and substitute “45 46".

AB230-AA1,3,5 10. Page 22, line 9: after “(7m)," insert “and".

AB230-AA1,3,6 11. Page 22, line 10: delete that line and substitute “(8v).”.
