SENATE SUBSTITUTE AMENDMENT 1,
TO ASSEMBLY BILL 47

AB47-SSA1,1,3 1An Act to amend 304.06 (1) (c) 3., 304.06 (1) (d) 1., 304.06 (1) (d) 2., 304.06 (1)
2(d) 3g., 304.06 (1) (eg) and 304.063 (2) (a); and to create 304.01 (3) and (4) of
3the statutes; relating to: public access to actions by Parole Commission.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB47-SSA1,1 4Section 1. 304.01 (3) and (4) of the statutes are created to read:
AB47-SSA1,1,105 304.01 (3) The department shall post on the department's public Internet site
6the individuals granted parole, denied parole, and returned to prison following the
7revocation of parole. The department shall post aggregate numbers that identify
8monthly totals and yearly totals. The yearly totals shall be presented by the crime
9for which the individual was convicted; the sex, race, and age of the individual; and
10the locality in which the individual was convicted.
AB47-SSA1,1,12 11(4) Any guidance documents that the parole commission uses to guide parole
12decisions shall be posted on the department's public Internet site.

1Section 2. 304.06 (1) (c) 3. of the statutes is amended to read:
AB47-SSA1,2,72 304.06 (1) (c) 3. The victim of the crime committed by the inmate or, if the victim
3died as a result of the crime, an adult member of the victim's family and any member
4of the victim's family who was younger than 18 years old at the time the crime was
5committed but is now 18 years old or older
or, if the victim is younger than 18 years
6old, the victim's parent or legal guardian, upon submission of a card under par. (f)
7requesting notification.
AB47-SSA1,3 8Section 3. 304.06 (1) (d) 1. of the statutes is amended to read:
AB47-SSA1,2,189 304.06 (1) (d) 1. The notice under par. (c) shall inform the offices and persons
10under par. (c) 1. to 3. of the manner in which they may provide written statements
11under this subsection, shall inform persons under par. (c) 3. of the manner in which
12that they may attend interviews or hearings and make statements under par. (eg)
13and shall inform persons under par. (c) 3. who are victims, or family members of
14victims, of crimes specified in s. 940.01, 940.03, 940.05, 940.225 (1), (2), or (3), 948.02
15(1) or (2), 948.025, 948.06, or 948.07 of the manner in which they may have direct
16input in the parole decision-making process under par. (em). The parole commission
17shall provide notice under this paragraph for an inmate's first application for parole
18and, upon request, for subsequent applications for parole.
AB47-SSA1,4 19Section 4. 304.06 (1) (d) 2. of the statutes is amended to read:
AB47-SSA1,2,2220 304.06 (1) (d) 2. The notice shall be by 1st class mail to an office's or a person's
21last-known address sent at least 3 weeks 90 days before the interview or hearing
22upon the application for parole.
AB47-SSA1,5 23Section 5. 304.06 (1) (d) 3g. of the statutes is amended to read:
AB47-SSA1,2,2524 304.06 (1) (d) 3g. If applicable, the notice shall state the date of the interview
25or hearing that is the person may attend subject of the notice.

1Section 6. 304.06 (1) (eg) of the statutes is amended to read:
AB47-SSA1,3,42 304.06 (1) (eg) The parole commission shall permit any person under par. (c)
33. to attend make a statement at any interview or hearing on the application for
4parole of an applicable inmate and to make a statement at that interview or hearing.
AB47-SSA1,7 5Section 7 . 304.063 (2) (a) of the statutes is amended to read:
AB47-SSA1,3,106 304.063 (2) (a) The victim of the crime committed by the prisoner or, if the
7victim died as a result of the crime, an adult member of the victim's family and any
8member of the victim's family who was younger than 18 years old at the time the
9crime was committed but is now 18 years old or older
or, if the victim is younger than
1018 years old, the victim's parent or legal guardian.
