5schools of barbering, schools of cosmetology, and specialty schools and requiring
6completion of a course on human trafficking as a condition of licensure for
7barbers, cosmetologists, aestheticians, electrologists, and manicurists.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Justice, in consultation with the Technical
College System Board, the Department of Safety and Professional Services, and the
Cosmetology Examining Board, to identify and establish industry specific materials
for use in providing instruction to students in schools of barbering, schools of
cosmetology, and specialty schools in the recognition and reporting of human
trafficking. Specialty schools are establishments that offer instruction in aesthetics,
electrology, or manicuring. Under the bill, DSPS and the Cosmetology Examining
Board must require that schools of barbering, schools of cosmetology, and specialty

schools provide instruction on the dynamics of exploitation including vulnerabilities
that put people at risk of being trafficked and how to recognize and report suspected
human trafficking as identified by DOJ under the bill.
Further, this bill requires that applicants for a license as a barber,
cosmetologist, aesthetician, electrologist, or manicurist complete, prior to being
issued an initial license or prior to license renewal, a course on human trafficking
offered by a school of barbering, school of cosmetology, or specialty school or a course
on human trafficking that is offered or endorsed by a state or federal agency and
approved by DSPS. The bill requires schools of barbering, schools of cosmetology,
and specialty schools to inform students of the requirements to complete a course on
human trafficking to qualify for licensure.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB981-ASA1,1 1Section 1 . 165.715 of the statutes is created to read:
AB981-ASA1,2,10 2165.715 Prevention of human trafficking. The department of justice, in
3consultation with the technical college system board, the department of safety and
4professional services, and the cosmetology examining board, shall, no later than one
5year following the effective date of this section .... [LRB insert date], identify and
6establish industry specific materials for use in providing instruction to students in
7schools of barbering licensed under s. 440.62 (3) (ag), schools of cosmetology licensed
8under s. 440.62 (3) (ar), and specialty schools licensed under s. 440.62 (4) in the
9recognition and reporting of human trafficking, including both sex trafficking and
10labor trafficking.

19put people at risk of being trafficked and how to recognize and report suspected
20human trafficking as identified by the department of justice under s. 165.715.
AB981-ASA1,9 21Section 9. 440.65 of the statutes is created to read:
AB981-ASA1,3,25 22440.65 Notification of required curriculum. Any school or specialty school
23licensed by the department under this subchapter shall inform all students of the
24requirements to complete a course on human trafficking to qualify for licensure
25under ss. 454.06 (1) (d) and 454.23 (2) (f).

1Section 10. 454.06 (1) (d) of the statutes is created to read:
AB981-ASA1,4,52 454.06 (1) (d) The applicant completes a course on human trafficking offered
3by a school of cosmetology or a specialty school under s. 440.62 (5) (b) 1m. or a course
4on human trafficking that is offered or endorsed by a state or federal agency and
5approved by the department.
AB981-ASA1,11 6Section 11. 454.06 (8) of the statutes is amended to read:
AB981-ASA1,4,167 454.06 (8) Expiration and renewal. The renewal date for licenses issued under
8subs. (2) to (6) is specified under s. 440.08 (2) (a), and the renewal fees for such
9licenses are determined by the department under s. 440.03 (9) (a). The examining
10board may not renew a license issued to a person under subs. (2) to (6) unless the
11person certifies to the examining board that the person has reviewed the current
12digest under s. 454.125 and that the person either satisfied sub. (1) (d) prior to being
13issued an initial license or completed a course on human trafficking offered by a
14school of cosmetology or a specialty school under s. 440.62 (5) (b) 1m. or a course on
15human trafficking that is offered or endorsed by a state or federal agency and
16approved by the department prior to license renewal

AB981-ASA1,12 17Section 12. 454.23 (2) (f) of the statutes is created to read:
AB981-ASA1,4,2118 454.23 (2) (f) The applicant completes a course on human trafficking offered
19by a school of barbering under s. 440.62 (5) (b) 2m. or a course on human trafficking
20that is offered or endorsed by a state or federal agency and approved by the
21department.
AB981-ASA1,13 22Section 13. 454.23 (5) of the statutes is amended to read:
AB981-ASA1,5,623 454.23 (5) Expiration and renewal. The renewal date for a license granted
24under sub. (2) is specified under s. 440.08 (2) (a), and the renewal fee for that license
25is determined by the department under s. 440.03 (9) (a). The department may not

1renew a license granted to a person under this section unless the person certifies to
2the department that the person has reviewed the current digest under s. 454.267 and
3that the person either satisfied sub. (2) (f) prior to being issued an initial license or
4completed a course on human trafficking offered by a school of barbering under s.
5440.62 (5) (b) 2m. or a course on human trafficking that is offered or endorsed by a
6state or federal agency and approved by the department prior to license renewal
