TO SENATE BILL 330

SB330-SA7,1,11 At the locations indicated, amend the bill as follows:
SB330-SA7,1,2 21. Page 1, line 6: delete “and" and substitute “, pupil discrimination,".
SB330-SA7,1,3 32. Page 1, line 7: after “districts" insert “, and providing a penalty".
SB330-SA7,1,4 43. Page 3, line 13: after that line insert:
SB330-SA7,1,5 5 Section 2g. 118.13 (1m) of the statutes is created to read:
SB330-SA7,1,116 118.13 (1m) No person may be denied admission to a charter school authorized
7under s. 118.40 (2r) or (2x) or a private school participating in a program under s.
8115.7915, 118.60, or 119.23 or be denied participation in, be denied the benefits of,
9or be discriminated against in any curricular, extracurricular, pupil services,
10recreational, or other program or activity because of the person's physical, mental,
11emotional, or learning disability.
SB330-SA7,2h 12Section 2h. 118.13 (2) (a) of the statutes is amended to read:

1118.13 (2) (a) Each school board, operator of a charter school authorized under
2s. 118.40 (2r) or (2x), and governing body of a private school participating in a
3program under s. 115.7915, 118.60, or 119.23
shall develop written policies and
4procedures to implement this section and submit them to the state superintendent
5as a part of its 1986 annual report under s. 120.18
. The policies and procedures shall
6provide for receiving and investigating complaints by residents of the school district
7regarding possible violations of this section, for making determinations as to
8whether this section has been violated and for ensuring compliance with this section.
SB330-SA7,2j 9Section 2j. 118.13 (3) (a) 3. of the statutes is amended to read:
SB330-SA7,2,1310 118.13 (3) (a) 3. Include in the department's biennial report under s. 15.04 (1)
11(d) information on the status of school district compliance with this section and
12school district progress toward providing reasonable equality of educational
13opportunity for all pupils in this state.
SB330-SA7,2k 14Section 2k. 118.13 (3) (b) 1. of the statutes is amended to read:
SB330-SA7,2,1915 118.13 (3) (b) 1. Periodically review school district programs, activities and
16services to determine whether the school boards, operators of charter schools
17established under s. 118.40 (2r) or (2x), and governing bodies of private schools
18participating in a program under s. 115.7915, 118.60, or 119.23
are complying with
19this section.
SB330-SA7,2m 20Section 2m. 118.13 (3) (b) 2. of the statutes is amended to read:
SB330-SA7,2,2421 118.13 (3) (b) 2. Assist school boards, operators of charter school established
22under s. 118.40 (2r) or (2x), and governing bodies of private schools participating in
23a program under s. 115.7915, 118.60, or 119.23
to comply with this section by
24providing information and technical assistance upon request.
SB330-SA7,2n 25Section 2n. 118.13 (4) of the statutes is amended to read:

1118.13 (4) Any public school or private school official, employee or teacher who
2intentionally engages in conduct which discriminates against a person or causes a
3person to be denied rights, benefits or privileges, in violation of sub. (1), may be
4required to forfeit not more than $1,000.”.
