Under current law, DOJ collects fees for performing background checks for handgun purchases and for performing certain services related to issuing licenses or certification cards to carry concealed weapons. The money received as fees for performing background checks for handgun purchases goes toward providing services related to background checks for handgun purchases, the money received as fees for performing services related to issuing a license to carry concealed weapons goes toward services related to issuing licenses to carry concealed weapons, and the money received as fees related to issuing certification cards to carry concealed weapons goes toward providing such services. Under this bill, any money received as fees for performing background checks for handgun purchases and for performing certain services related to issuing licenses or certification cards to carry concealed weapons may go toward providing services related to background checks for handgun purchases, licenses to carry concealed weapons, or certification cards to carry concealed weapons.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section 1. 20.455 (2) (gr) of the statutes is amended to read:
20.455 (2) (gr) Handgun purchaser record check; checks for licenses or certifications to carry concealed weapons. All moneys received as fee payments under s. ss. 175.35 (2i), 175.49 (5m), and 175.60 (7) (c) and (d), (13), and (15) (b) 4. a. and b. to provide services under s. ss. 175.35, 175.49, and 175.60.

Section 2. 20.455 (2) (gs) of the statutes is repealed.

Section 4. 175.49 (5m) of the statutes is amended to read:
175.49 (5m) Fees. The department may charge a fee to verify eligibility for a certification card under this section, for the issuance of a certification card under sub. (3), or for the renewal of a certification card under sub. (5), but the fee may not exceed the costs the department incurs in verifying eligibility or for issuing or renewing a certification card. Payments made to the department under this subsection shall be credited to the appropriation account under s. 20.455 (2) (gu) (gr).
