Under current law, DNR may issue a general permit authorizing a vessel that is 79 feet or greater in length to discharge ballast water into the waters of the state. If DNR issues a general permit, DNR must charge a person who seeks coverage under the general permit a specified application fee and an annual fee. These fees apply only before July 1, 2013. Current law requires DNR to promulgate rules to establish the fees that apply beginning on July 1, 2013.
This bill eliminates the requirement that DNR promulgate rules to establish the general permit application fee and annual fee that apply on and after July 1, 2013. Under this bill, the fees that are currently established in the statutes continue to apply through June 30, 2015.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section 1. 283.35 (1m) (c) of the statutes is amended to read:
283.35 (1m) (c) Paragraph (b) does not apply after June 30, 2013 2015.
Section 2. 283.35 (1m) (d) of the statutes is repealed.
