Wisconsin Works
Under current law, the Learnfare program requires school age children of Wisconsin Works (W-2) participants, with some exceptions, to meet certain school enrollment standards. An individual who fails to meet the school attendance requirement may be subject to sanctions determined by DCF by rule. Under current law, an individual fails to meet the school attendance requirement if the individual is not enrolled in school or was not enrolled in the immediately preceding semester. Under this bill, an individual who is habitually truant or who in the immediately preceding semester was habitually truant also fails to meet the school attendance requirement.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section 1. 49.26 (1) (ge) of the statutes is renumbered 49.26 (1) (ge) 1. (intro.) and amended to read:
49.26 (1) (ge) 1. (intro.) An individual fails to meet the school attendance requirement if the individual meets at least one of the following conditions:
a. The individual is either not enrolled in school or was not enrolled in the immediately preceding semester or is a habitual truant.
2. The Wisconsin works Works agency or county department shall verify school enrollment and attendance.
Section 2. 49.26 (1) (ge) 1. b. of the statutes is created to read:
49.26 (1) (ge) 1. b. During the immediately preceding semester, the individual was either not enrolled in school or was a habitual truant.
