Drug Paraphernalia
Under current law, it is a crime to use, possess, manufacture, or deliver drug paraphernalia. Drug paraphernalia is anything that is used in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing, or introducing into the human body a controlled substance. Drug paraphernalia excludes hypodermic syringes, needles and other objects used in parenterally injecting substances into the human body, and any items that are designed for use with tobacco products. Under this bill, drug paraphernalia also excludes any materials used to test for the presence of fentanyl in a substance.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section
1. 961.571 (1) (b) 3. of the statutes is created to read:
961.571 (1) (b) 3. Any materials used or intended for use in testing for the presence of fentanyl or a fentanyl analog in a substance.
