Vehicle registration and trail use fee retention
This bill provides that DNR may retain a fee for issuing all-terrain vehicle trail passes and snowmobile trail use stickers and for issuing and renewing registrations for all-terrain vehicles, utility terrain vehicles, off-highway motorcycles, boats, and snowmobiles (collectively, outdoor recreation vehicles) that occur through DNR's statewide automated system.
Under current law, certain uses of outdoor recreation vehicles are prohibited unless the vehicles are registered with DNR. Subject to certain exemptions, outdoor recreation vehicles may not be operated on all-terrain vehicle trails or snowmobile trails without the applicable trail pass or use sticker. DNR may appoint agents who are not DNR employees to issue trail passes and stickers and to issue and renew outdoor recreation vehicle registrations. In addition to the applicable fee for the trail pass or sticker or vehicle registration, agents are authorized to collect and retain an issuance fee and, for vehicle registrations, a transaction fee.
Under the bill, for issuances that occur through DNR's statewide automated system, DNR is authorized to retain the issuance and transaction fees, which are credited to an appropriation in DNR's external services program. The bill also credits to this appropriation various fees collected to renew, transfer, and replace registrations for outdoor recreation vehicles.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section
1. 20.370 (9) (hu) of the statutes is amended to read:
20.370 (9) (hu) Handling and other fees. All moneys received by the department as provided under ss. 23.33 (2) (i), (ig), and (o) and (2j) (f) 4., 23.335 (4) (hm) and (5) (h), 29.2297, 29.556, 30.52 (1m) (a), (ag), and (e) and (3) (k), 30.537 (4) (g), and 350.12 (3) (f), (3h) (a), (ag), and (g), and (3j) (e) 4. for the issuing of department and federal approvals under ch. 29 and for the issuing and renewing of certificates and registrations by the department under ss. 23.33 (2) (i) and (ig), 30.52 (1m) (a) and (ag), and 350.12 (3h) (a) and (ag).

2. 23.33 (2) (ir) of the statutes is amended to read:
23.33 (2) (ir) Registration; supplemental fee. In addition to the applicable fee under par. (c), (d), or (e), each when an agent appointed under par. (i) 3. who accepts an application to renew registration documents in person
, or the department accepts an application to renew registration documents through a statewide automated system, the agent or the department shall collect an issuing fee of 50 cents and a transaction fee of 50 cents each time the agent or the department issues renewal registration documents under par. (ig) 1. a. or b. The agent or the department shall retain the entire amount of each issuing fee and transaction fee the agent or the department collects.

3. 23.33 (2) (o) of the statutes is amended to read:
23.33 (2) (o) Receipt of all-terrain vehicle fees. All fees remitted to or collected by the department under par. (c) 1., (e), or (ir) for services provided regarding all-terrain vehicles shall be credited to the appropriation account under s. 20.370 (9) (hu).

4. 23.33 (2j) (f) 4. of the statutes is created to read:
23.33 (2j) (f) 4. All fees remitted to or collected by the department under subd. 2. shall be credited to the appropriation account under s. 20.370 (9) (hu).

5. 23.335 (4) (h) of the statutes is amended to read:
23.335 (4) (h) Registration; supplemental fee. In addition to the applicable fee under par. (d) 1., 2., or 3. or (e) 2., each
when an agent appointed under par. (f) 2. who accepts an application to renew registration documents in person, or the department accepts an application to renew registration documents through a statewide automated system, the agent or the department shall collect an issuing fee of 50 cents and a transaction fee of 50 cents each time the agent or the department issues renewal registration documents under par. (g) 1. or 2. The agent
or the department shall retain the entire amount of each issuing fee and transaction fee the agent or the department collects.

6. 23.335 (4) (hm) of the statutes is created to read:
23.335 (4) (hm) Receipt of fees. All fees remitted to or collected by the department under par. (d) 1., 2., or 3. or (h) shall be credited to the appropriation account under s. 20.370 (9) (hu).

, or the department accepts an application to renew registration documents through a statewide automated system, the agent or the department shall collect an issuing fee of 50 cents and a transaction fee of 50 cents each time the agent or the department issues renewal certification or registration documents or a renewal temporary operating receipt under par. (ag) 1. or 2. The agent or the department shall retain the entire amount of each issuance and transaction fee the agent or the department collects.

9. 30.52 (3) (k) of the statutes is created to read:
30.52 (3) (k) Use of fees. All fees remitted to or collected by the department under par. (j) shall be credited to the appropriation account under s. 20.370 (9) (hu).

10. 30.537 (4) (g) of the statutes is created to read:
30.537 (4) (g) All fees remitted to or collected by the department under pars. (a), (c), and (d) shall be credited to the appropriation account under s. 20.370 (9) (hu).
