Public defender private attorney rate increases for inflation
Under current law, for any case assigned on or after January 1, 2020, the rate at which the public defender must pay a private local attorney to whom a case is assigned is $70 per hour for time spent related to a case, excluding travel, and $25 per hour for time spent in travel related to a case.
This bill provides that the rate at which the public defender must pay a private local attorney to whom a case is assigned on or after January 1, 2020 must be adjusted biennially by a percentage that correlates with the federal Department of Labor's consumer price index. Under the bill, the first of these adjustments will be on July 1, 2023.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section 1. 977.08 (4s) of the statutes is created to read:
977.08 (4s) Beginning on July 1, 2023, and biennially on July 1 of each odd-numbered year thereafter, the rates established under sub. (4m) (d) shall be adjusted by a percentage equal to the average of the consumer price index over the preceding 12-month period, all items, U.S. city average, as determined by the bureau of labor statistics of the federal department of labor, except that the percentage under this subsection may not be less than zero.
