AB1013,1,3 1An Act to amend 134.72 (1) (b) and 134.72 (2) (b) 2.; and to create 134.72 (2) (b)
21. c. and 134.72 (2) (c) of the statutes; relating to: unsolicited documents
3transmitted by facsimile machine.

Current law restricts the transmittal of unsolicited documents by facsimile
machine. These restrictions prohibit unsolicited documents that are more than one
page and the transmittal of unsolicited documents to persons with whom the person
sending the documents has not had a prior business relationship.
Current law covers unsolicited facsimile transmissions that encourage a person
to purchase property, goods or services. This bill expands this coverage to include the
rental and other types of acceptance of these items and the extension of credit.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB1013, s. 1 4Section 1. 134.72 (1) (b) of the statutes is amended to read:
AB1013,1,85 134.72 (1) (b) "Facsimile solicitation" means the unsolicited transmission of a
6document by a facsimile machine for the purpose of encouraging a person to
7purchase, rent, or otherwise accept property, goods or services or to accept an
8extension of credit
.

1Section 2. 134.72 (2) (b) 1. c. of the statutes is created to read:
AB1013,2,32 134.72 (2) (b) 1. c. The facsimile solicitation contains the notification specified
3in par. (c).
AB1013, s. 3 4Section 3. 134.72 (2) (b) 2. of the statutes is amended to read:
AB1013,2,85 134.72 (2) (b) 2. Notwithstanding subd. 1., a person may not make a facsimile
6solicitation to a person who has notified the facsimile solicitor in writing or, by
7facsimile transmission, or by calling the toll-free telephone number under par. (c)
8that the person does not want to receive facsimile solicitation.
AB1013, s. 4 9Section 4. 134.72 (2) (c) of the statutes is created to read:
AB1013,2,1410 134.72 (2) (c) The notification under par. (b) 1. c. shall be in type not smaller
11than 9 point and shall contain a toll-free telephone number and an address with
12which the person solicited may communicate to notify the person making the
13solicitation not to send facsimile solicitation to the facsimile telephone numbers
14specified by the person solicited.
AB1013, s. 5 15Section 5. Effective date.
AB1013,2,17 16(1) This act takes effect on the first day of the 3rd month beginning after
17publication.
