AB1018,1,3 1An Act to repeal 1995 Wisconsin Act 27, section 9108 (7); and to amend 20.866
2(2) (ux) of the statutes; relating to: the funding of a prison expansion project
3under the state building program and granting bonding authority.
Analysis by the Legislative Reference Bureau
1995 Wisconsin Act 27 increased the general obligation bonding authority for
state building program capital costs by $25,000,000 for a prison expansion project.
Under the act, the state building commission may not authorize the contracting of
public debt for the prison expansion project unless the state receives federal funding
for the project.
This bill increases the general obligation bonding authority for the prison
expansion project by $50,000,000, from $25,000,000 to $75,000,000. The bill also
eliminates the requirement in 1995 Wisconsin Act 27 that the state receive federal
funding for the prison expansion project before the building commission may
authorize the contracting of public debt for the prison expansion project. The bill
does not change the authority of the building commission under current law to
substitute federal funds in whole or in part for the borrowing authority provided
under the bill for the prison expansion project. Finally, the bill requires the
department of corrections to seek to identify and secure federal funding for the prison
expansion project.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 20.866 (2) (ux) of the statutes, as affected by 1995 Wisconsin Act 27,
2is amended to read:
AB1018,2,73 20.866 (2) (ux) Corrections; correctional facilities. From the capital
4improvement fund, a sum sufficient for the department of corrections to acquire,
5construct, develop, enlarge or improve adult and juvenile correctional facilities. The
6state may contract public debt in an amount not to exceed $465,087,500
7$515,087,500 for this purpose.

In 1995 Wisconsin Act 27, section 9108 (1) (b) 1., under
12projects financed by general fund supported borrowing, the amount authorized for
13the prison expansion project is increased from $25,000,000 to $75,000,000 and the
14appropriate totals are adjusted accordingly.

17financed by federal funds, the 1995-97 state building program project identified as
