AB1023,1,3 An Act to amend 84.61 (4); and to create 84.61 (4m) of the statutes; relating to: construction activities relating to highway resurfacing and bridge repair on the East-West Freeway in Milwaukee County.

Analysis by the Legislative Reference Bureau

Under current law, the department of transportation (DOT) may not encumber any funds in the 1995-97 fiscal biennium for construction activities relating to highway resurfacing or bridge repair on the East-West Freeway between downtown Milwaukee and Waukesha in Milwaukee County except from the following reserve accounts in the transportation fund: 2 accounts totaling $26,698,000 upon authorization from the joint committee on finance, and an additional account of $15,000,000 that may also be used for state highway rehabilitation associated with the construction of a new stadium to be used by the Milwaukee Brewers, a professional baseball team located in Milwaukee County. This limitation on funding does not apply to a federal demonstration grant.

This bill removes this limitation on funding in the 1995-97 fiscal biennium. The bill also requires DOT to substantially complete all construction activities relating to highway resurfacing and bridge repair on the East-West Freeway by December 31, 1998.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB1023, s. 1 Section 1. 84.61 (4) of the statutes, as created by 1995 Wisconsin Act 113, is amended to read:

AB1023,2,7 84.61 (4) The department may not encumber any funds in the 1995-97 fiscal biennium for the purpose of funding state highway rehabilitation associated with the construction of a new stadium to be used by the Milwaukee Brewers, a professional baseball team located in Milwaukee County, or construction activities relating to highway resurfacing or bridge repair on the East-West Freeway from downtown Milwaukee to Waukesha except as provided in this section. This subsection does not apply to the encumbrance of funds pursuant to a federal demonstration grant.

AB1023, s. 2 Section 2. 84.61 (4m) of the statutes is created to read:

AB1023,2,11 84.61 (4m) The department shall substantially complete all construction activities relating to highway resurfacing and bridge repair on the East-West Freeway from downtown Milwaukee to Waukesha by December 31, 1998.
