AB1049,1,3 1An Act to amend 348.19 (1) (a); and to create 348.19 (1) (am) and 348.20 (3) of
2the statutes; relating to: the enforcement of vehicle weight limitations and ve
3hicle combinations that include a gooseneck-type trailer.

Current law permits a traffic officer who has reason to believe that a vehicle
weight limitation is being violated to require the vehicle operator to stop and submit
the vehicle and load to a weighing or to escort the vehicle to a scale for weighing.
This bill provides that a traffic officer may not require the operator of a com
bination of vehicles that includes a towing vehicle and a gooseneck-type trailer to
submit each vehicle of the vehicle combination to a weighing if the gross weight of
the combination of vehicles is not more than the aggregate combined registered gross
weight of the vehicle combination. The bill also provides that no operator of a com
bination of vehicles that includes a towing vehicle and a gooseneck-type trailer may
be convicted of any overweight violation if the gross weight of the combination of ve
hicles is not more than the aggregate combined registered gross weight of the vehicle
combination.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB1049, s. 1 4Section 1. 348.19 (1) (a) of the statutes is amended to read:
AB1049,2,55 348.19 (1) (a) Any Except as provided in pars. (am) and (b), any traffic officer
6having reason to believe that the gross weight of a vehicle is unlawful or in excess

1of the gross weight for which the vehicle is registered may require the operator of
2such vehicle to stop and submit the vehicle and any load it may be carrying to a
3weighing by means of either portable or certified stationary scales and may require
4that such vehicle be driven to the nearest usable portable or certified stationary scale
5except as provided in par. (b).
AB1049, s. 2 6Section 2. 348.19 (1) (am) of the statutes is created to read:
AB1049,2,117 348.19 (1) (am) No traffic officer may require the operator of a combination of
8vehicles that includes a towing vehicle and a gooseneck-type trailer to submit each
9vehicle of the vehicle combination and any load that it may be carrying to a weighing
10if the gross weight of the combination of vehicles does not exceed the aggregate com
11bined registered gross weight of the vehicle combination.
