Analysis by the Legislative Reference Bureau
Under current law, every employer who owns or operates a factory or
mercantile establishment, subject to certain exceptions, must allow every person
employed in the factory or mercantile establishment to take at least 24 consecutive
hours of rest in every 7 consecutive days (one day of rest in 7). Currently, however,
the one day of rest in 7 law does not apply to persons employed in the manufacture
of butter, cheese or other dairy products or in the distribution of milk or cream. This
bill limits the exception to the one day of rest in 7 law to persons employed in the
manufacture of butter, cheese or other dairy products from fresh milk or in the
distribution of fresh milk or cream.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1(1) This act first applies to employes who are covered by a collective bargaining
2agreement that contains provisions inconsistent with section 103.85 (2) (c) of the
3statutes, as affected by this act, on the day after the collective bargaining agreement
4expires, or on the day on which the collective bargaining agreement is extended,
5modified or renewed.
