AB1091,1,5 1An Act to repeal 84.61 (1); to amend 84.61 (4) and 85.21 (4) (a); and to create
285.21 (5) of the statutes; relating to: transportation services for elderly and
3disabled persons, elimination of a reserve account in the state transportation
4fund for certain state highway rehabilitation projects and making an appropri
5ation.
Analysis by the Legislative Reference Bureau
Under current law, DOT administers a program to provide financial assistance
to counties providing transportation services for elderly and disabled persons. This
bill requires counties to develop a coordinated plan for the local delivery of trans
portation services to the elderly and disabled, regardless of funding source, and di
rects counties to coordinate such services with those provided to other persons re
quiring specialized transportation service wherever practicable. The bill also
requires the secretary of transportation, in cooperation with the department of
education, the department of health and social services and other interested persons
or groups, to establish a task force on transportation services for elderly and disabled
persons.
1995 Wisconsin Act 113 (the executive transportation budget) created a reserve
account of $15,000,000 in the segregated transportation fund to be expended for state
highway rehabilitation associated with the construction of a new stadium to be used
by the Milwaukee Brewers and for construction activities relating to highway resur
facing or bridge repair on the East-West Freeway from downtown Milwaukee to
Waukesha. The bill repeals the special reserve account in the segregated transporta
tion fund for state highway rehabilitation associated with the construction of a new
stadium to be used by the Milwaukee Brewers and for construction activities relating
to highway resurfacing or bridge repair on the East-West Freeway from downtown
Milwaukee to Waukesha. The $15,000,000 is appropriated for the program that pro

vides financial assistance to counties providing transportation services for elderly
and disabled persons. The bill does not affect other reserve accounts allocated for
construction activities on the East-West Freeway.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB1091, s. 1 2Section 1. 84.61 (1) of the statutes, as created by 1995 Wisconsin Act 113, is
3repealed.
AB1091, s. 2 4Section 2. 84.61 (4) of the statutes, as created by 1995 Wisconsin Act 113, is
5amended to read:
AB1091,2,126 84.61 (4) The department may not encumber any funds in the 1995-97 fiscal
7biennium for the purpose of funding state highway rehabilitation associated with the
8construction of a new stadium to be used by the Milwaukee Brewers, a professional
9baseball team located in Milwaukee County, or
construction activities relating to
10highway resurfacing or bridge repair on the East-West Freeway from downtown Mil
11waukee to Waukesha except as provided in this section. This subsection does not ap
12ply to the encumbrance of funds pursuant to a federal demonstration grant.
AB1091, s. 3 13Section 3. 85.21 (4) (a) of the statutes is amended to read:
AB1091,3,314 85.21 (4) (a) The Each county shall establish a county transportation advisory
15committee or direct its commission on aging to develop a coordinated county trans
16portation plan for service to elderly and disabled persons, based on all federal, state
17and local funds available to the county for the service. A county
may establish the
18transportation of elderly and disabled persons to medical, nutritional and work-re
19lated activities as the priority for the specialized transportation services. A county

1shall coordinate transportation services for the elderly and disabled with those pro
2vided for school pupils and others requiring specialized transportation service, wher
3ever practicable.
AB1091, s. 4 4Section 4. 85.21 (5) of the statutes is created to read:
AB1091,3,145 85.21 (5) Task force on transportation services for elderly and disabled
6persons.
The secretary of transportation shall establish a task force on transporta
7tion services for elderly and disabled persons in cooperation with the department of
8health and social services, the department of education and other interested persons
9or groups. The task force shall meet at the call of the secretary of transportation to
10plan a coordinated system of transportation services for elderly and disabled persons
11which efficiently uses all federal and state funding sources available to the depart
12ments. A progress report shall be prepared by the secretary of transportation and
13submitted to the appropriate standing committees dealing with transportation mat
14ters under s. 13.172 (3) by January 1, 1997, and updated annually thereafter.

AB1091,3,21 16(1)  Elderly and disabled county aids. In the schedule under section 20.005
17(3) of the statutes for the appropriation to the department of transportation under
18section 20.395 (1) (cr) of the statutes, as affected by the acts of 1995, the dollar
19amount is increased by $7,500,000 for fiscal year 1995-96 and the dollar amount is
20increased by $7,500,000 for fiscal year 1996-97 to increase funding for the purpose
21for which the appropriation is made.
