AB112,1,3 1An Act to repeal 165.83 (2) (a) 3.; and to amend 165.83 (2) (a) 2. of the statutes;
2relating to: obtaining fingerprints and other information from persons who
3are arrested or taken into custody.
Analysis by the Legislative Reference Bureau
Currently, local law enforcement agencies must obtain fingerprints and other
identifying data regarding persons who have been arrested or taken into custody for
any felony or for specified misdemeanors or ordinance violations. The agencies must
shortly thereafter forward the fingerprints and other data to the department of
justice, which files the information and makes it available for various purposes. This
bill expands the coverage of these requirements to include any misdemeanor
prohibited under the criminal code, controlled substances act or public assistance
laws.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB112, s. 1 4Section 1. 165.83 (2) (a) 2. of the statutes is amended to read:
AB112,2,25 165.83 (2) (a) 2. For an offense which that is a misdemeanor under chs. 49, 161,
6939 to 948 or 951
or a violation of an ordinance involving burglary tools, commercial
7gambling, dealing in gambling devices, contributing to the delinquency of a child,
8dealing in stolen property, controlled substances under ch. 161, firearms, dangerous

1weapons, explosives, pandering, prostitution, sex offenses where children are
2victims, or worthless checks.
AB112, s. 2 3Section 2. 165.83 (2) (a) 3. of the statutes is repealed.

AB112,2,6 5(1) This act first applies to fingerprints and other identifying data obtained
6from persons arrested or taken into custody on the effective date of this subsection.
