AB173,1,2 1An Act to create 36.11 (6) (c), 38.04 (27), 39.28 (6) and 45.35 (18) of the statutes;
2relating to: prohibiting educational grants to state prison inmates.
Analysis by the Legislative Reference Bureau
Under current law, the higher educational aids board, the board of regents of
the University of Wisconsin System, the technical college system board and the
department of veterans affairs award grants to persons for enrollment at an
institution of higher education. This bill provides that no such grants may be
awarded to persons who are inmates in Type 1 prisons (all state prisons except the
intensive sanctions program).

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB173, s. 1 3Section 1. 36.11 (6) (c) of the statutes is created to read:
AB173,1,64 36.11 (6) (c) The board may not make a grant under this chapter to a person
5for enrollment at any center or institution within the system if the person is an
6inmate in a Type 1 prison, as defined in s. 301.01 (5).
AB173, s. 2 7Section 2. 38.04 (27) of the statutes is created to read:
AB173,2,28 38.04 (27) Grants to prison inmates. The board may not make a grant under
9this chapter to a person for enrollment at an institution of higher education, as

1defined in s. 39.32 (1) (a), if the person is an inmate in a Type 1 prison, as defined in
2s. 301.01 (5).
AB173, s. 3 3Section 3. 39.28 (6) of the statutes is created to read:
AB173,2,54 39.28 (6) The board may not make a grant under this subchapter to a student
5if the student is an inmate in a Type 1 prison, as defined in s. 301.01 (5).
AB173, s. 4 6Section 4. 45.35 (18) of the statutes is created to read:
AB173,2,107 45.35 (18) Educational benefits. The department may not make a grant under
8this chapter to a veteran for enrollment at an institution of higher education, as
9defined in s. 39.32 (1) (a), if the veteran is an inmate in a Type 1 prison, as defined
10in s. 301.01 (5).
