AB226,1,3 1An Act to create 36.38, 38.12 (12), 39.49, 118.39 and 175.22 of the statutes;
2relating to: written policies on entering locker rooms being used by athletic
3teams representing certain schools or by professional athletic teams.

This bill requires each school board, private school, technical college district
board, institution and center within the University of Wisconsin System, private
institution of higher education, and professional athletic team that has its home field
or arena in this state, to adopt a written policy on who may enter and remain in a
locker room used by the school or team for the purpose of interviewing or seeking
information from any person. The policy must reflect the privacy interests of the
members of the teams representing the school or the professional athletic team.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB226, s. 1 4Section 1. 36.38 of the statutes is created to read:
AB226,2,2 536.38 Policy on privacy in athletic locker rooms. Each institution and
6center within the system shall adopt a written policy on who may enter and remain,
7for the purpose of interviewing or seeking information from any person, in a locker
8room being used by an athletic team representing the institution or center. The

1policy shall reflect the privacy interests of members of athletic teams representing
2the institution or center.
AB226, s. 2 3Section 2. 38.12 (12) of the statutes is created to read:
AB226,2,84 38.12 (12) Policy on privacy in athletic locker rooms. The district board shall
5adopt a written policy on who may enter and remain, for the purpose of interviewing
6or seeking information from any person, in a locker room being used by an athletic
7team representing the district. The policy shall reflect the privacy interests of
8members of athletic teams representing the district.
AB226, s. 3 9Section 3. 39.49 of the statutes is created to read:
AB226,2,14 1039.49 Policy on privacy in athletic locker rooms. (1) In this section,
11"institution of higher education" means a private educational institution that
12awards a bachelor's or higher degree or provides a program that is acceptable for
13credit toward such a degree, and that fields an athletic team that represents the
14institution.
AB226,2,19 15(2) Each institution of higher education shall adopt a written policy on who
16may enter and remain, for the purpose of interviewing or seeking information from
17any person, in a locker room being used by an athletic team representing the
18institution. The policy shall reflect the privacy interests of members of athletic
19teams representing the institution.
AB226, s. 4 20Section 4. 118.39 of the statutes is created to read:
AB226,3,2 21118.39 Policy on privacy in athletic locker rooms. Each school board, and
22the governing body of each private school that fields an athletic team representing
23the school, shall adopt a written policy on who may enter and remain, for the purpose
24of interviewing or seeking information from any person, in a locker room being used
25by an athletic team representing the private school or representing a public school

1in the school district. The policy shall reflect the privacy interests of members of
2athletic teams representing the school.
AB226, s. 5 3Section 5. 175.22 of the statutes is created to read:
AB226,3,9 4175.22 Policy on privacy for professional athletic teams. Any
5professional athletic team that has its home field or arena in this state shall adopt
6a written policy on who may enter and remain, for the purpose of interviewing or
7seeking information from any person, in a locker room used by the professional
8athletic team. The policy shall reflect the privacy interests of members of the
9professional athletic team.
AB226, s. 6 10Section 6. Effective date.
AB226,3,12 11(1) This act takes effect on the first day of the 6th month beginning after
12publication.
