AB261,1,2 1An Act to amend 19.82 (2); and to create 60.50 (6) of the statutes; relating to:
2the definition of "meeting" under the open meetings law.

Currently, under the open meetings law, subject to some limited exceptions, all
meetings of all state and local governmental bodies must be preceded by public
notice, be held at places reasonably accessible to members of the public and be open
to the public at all times.
Also under current law, the definition of a "meeting" that is subject to the open
meetings law is, subject to several conditions, the convening of members of a
governmental body for the purpose of exercising the responsibilities, authority,
power or duties delegated to or vested in the body. "Meeting" does not include any
social or chance gathering or conference that is not intended to avoid the open
meetings law or certain gatherings of the members of a drainage board to observe or
supervise the construction or maintenance of drains, highways and certain other
structures.
Under this bill, the definition of "meeting" for the purposes of the open meetings
law does not include the gathering of the members of a town board at the site of a
public works or road project, that has been approved by the town board, to inspect
the work that has been completed or that is in progress.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB261, s. 1 3Section 1. 19.82 (2) of the statutes is amended to read:

119.82 (2) "Meeting" means the convening of members of a governmental body
2for the purpose of exercising the responsibilities, authority, power or duties
3delegated to or vested in the body. If one-half or more of the members of a
4governmental body are present, the meeting is rebuttably presumed to be for the
5purpose of exercising the responsibilities, authority, power or duties delegated to or
6vested in the body. The term does not include any social or chance gathering or
7conference which is not intended to avoid this subchapter, any gathering of the
8members of a town board for the purpose specified in s. 60.50 (6)
or any gathering of
9the members of a drainage board created under s. 88.16, 1991 stats., or under s.
1088.17, for a purpose specified in s. 88.065 (5) (a).
AB261, s. 2 11Section 2. 60.50 (6) of the statutes is created to read:
AB261,2,1412 60.50 (6) Inspections. Gather at the site of a public works project or a highway,
13street or alley project that has been approved by the town board for the purpose of
14inspecting the work that has been completed or that is in progress.
