AB27,1,3 1An Act to amend 301.08 (1) (b) 2. of the statutes; relating to: allowing the
2department of corrections to enter into contracts with others to operate prisons
3and granting rule-making authority.
Analysis by the Legislative Reference Bureau
Under current law, the department of corrections (DOC) may purchase care or
services as an alternative to DOC providing the care or services itself. DOC also has
specific authority to contract with a public, private or voluntary agency to operate
a minimum security state prison. This bill authorizes DOC to enter into a contract
with a public, private or voluntary agency to operate any state prison. The contract
must include a requirement that the costs to the state be reduced by at least 10% as
adjusted for inflation.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB27, s. 1 4Section 1. 301.08 (1) (b) 2. of the statutes is amended to read:
AB27,2,65 301.08 (1) (b) 2. Contract with one any public, private or voluntary agency for
6the supervision, maintenance and operation of one minimum security a correctional
7institution in a county having a population of 500,000 or more. To be eligible, an
8agency must have prior relevant experience. Any contract entered into after the

1effective date of this subdivision .... [revisor inserts date], shall include a provision
2requiring that the costs to the state immediately prior to the date on which the
3contract goes into effect for the supervision, maintenance and operation of the
4institution be reduced by at least 10%, taking into account the affects of inflation.
5The department shall promulgate rules under this subdivision to specify how to
6determine cost savings and the effects of inflation under this subdivision
