AB281,1,3 1An Act to amend 144.3716 (3) (a); and to create 144.3716 (3) (c) of the statutes;
2relating to: the prohibition on the sale of gasoline other than reformulated
3gasoline in certain areas of this state.
Analysis by the Legislative Reference Bureau
Federal law prohibits the sale of any gasoline other than reformulated gasoline
in certain areas in which the federal standards for ozone in the atmosphere are
exceeded, including the severe ozone nonattainment area in the southeastern part
of this state. Reformulated gasoline is gasoline formulated to reduce emissions of
volatile organic compounds and toxic air pollutants. Current state law also prohibits
the sale of any gasoline except reformulated gasoline in the area in which the federal
prohibition applies. State law authorizes the prohibition on the sale of gasoline other
than reformulated gasoline to be extended to other areas of the state under certain
circumstances.
This bill authorizes the secretary of natural resources to grant a waiver from
the prohibition on the sale of gasoline other than reformulated gasoline if the
secretary determines that the federal prohibition is suspended or terminated.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB281,2,25 144.3716 (3) (a) Except as provided in under par. (b) or (c), beginning on
6January 1, 1995, no person may sell gasoline in an area described under sub. (2) (a),

1(am) or (b) unless the gasoline satisfies the minimum specifications for reformulated
2gasoline under s. 168.04.
AB281, s. 2 3Section 2. 144.3716 (3) (c) of the statutes is created to read:
AB281,2,64 144.3716 (3) (c) If the secretary determines that the requirement for the use
5of reformulated gasoline in areas of this state under 42 USC 7545 (k) is suspended
6or terminated, the secretary may grant a waiver from the prohibition under par. (a).
