AB318,1,3 1An Act to amend 562.06 (title) and (1), 562.06 (4), 562.06 (5), 563.51 (13) (intro.)
2and (a), 565.12 (1) (f) 1., 565.17 (4) and 565.30 (2) of the statutes; relating to:
3raising the legal age to gamble from 18 to 21 years of age.

Under current law, a person may not gain admission to a racetrack, wager on
races, play any regulated bingo game, purchase a lottery ticket or receive a lottery
prize payment unless that person is 18 years of age. This bill raises the legal age for
these gambling activities to 21 years of age.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB318, s. 1 4Section 1. 562.06 (title) and (1) of the statutes are amended to read:
AB318,2,2 5562.06 (title) Minors on racetracks; wagering prohibited Age for
6admission to racetracks and for wagering
. (1) Admission. Except as provided
7under subs. (2) and (3), no person under the age of 18 21 years may be admitted to
8a racetrack, or a track located at a fair where there is racing, unless accompanied by
9a parent, grandparent, greatgrandparent, guardian or spouse who is at least 18 21
10years of age, or unless accompanied by another person at least 18 21 years of age with

1the written permission of the minor's parent or guardian of the person who is under
2the age of 21 years
.
AB318, s. 2 3Section 2. 562.06 (4) of the statutes is amended to read:
AB318,2,54 562.06 (4) Placing a wager. No person under the age of 18 21 years may make
5a wager in any race or receive any payout on a wager.
AB318, s. 3 6Section 3. 562.06 (5) of the statutes is amended to read:
AB318,2,97 562.06 (5) Accepting a wager; making a payout. No licensee may knowingly
8accept a wager from any person under the age of 18 21 years or make any payout on
9a wager to any person under the age of 18 21 years.
AB318, s. 4 10Section 4. 563.51 (13) (intro.) and (a) of the statutes are amended to read:
AB318,2,1211 563.51 (13) Age limitations. (intro.) No A person under age 18 shall 21 may
12not do any of the following

AB318,2,1513 (a) Play any bingo game conducted by a licensed organization, unless
14accompanied by that person's parent, guardian or spouse who is at least 21 years of

AB318, s. 5 16Section 5. 565.12 (1) (f) 1. of the statutes is amended to read:
AB318,2,1817 565.12 (1) (f) 1. The intentional sale of lottery tickets or lottery shares to any
18person under the age of 18 21.
AB318, s. 5 19Section 5. 565.17 (4) of the statutes is amended to read:
AB318,2,2420 565.17 (4) Age. (a) A person under 18 21 years of age may not purchase a
21lottery ticket or lottery share or claim a prize for a winning lottery ticket or lottery
22share from the board or a retailer
. This paragraph does not prohibit a person 18 21
23years of age or older from giving a lottery ticket or lottery share to a person under
2418 21 years of age.

1(b) No person may sell a lottery ticket or lottery share to a person under 18 21
2years of age or to any other person knowing that the lottery ticket or lottery share
3is being purchased for a person under 18 21 years of age other than as a gift.
AB318,3,74 (c) No person may pay a prize for a winning lottery ticket or lottery share to any
5person knowing that the purchaser was under 18 21 years of age or knowing that the
6lottery ticket or lottery share was purchased for a person under 18 21 years of age
7other than as a gift.
AB318, s. 6 8Section 6. 565.30 (2) of the statutes is amended to read:
AB318,3,159 565.30 (2) (title) Payment of prizes to minors persons under 21. If the prize
10for a winning lottery ticket or lottery share given to a minor person under the age of

is less than $1,000, the administrator may make payment of the prize by
12delivering to an adult a member of the minor's person's family, or to the minor's
13person's guardian, a check or draft payable to the minor person. If the prize is $1,000
14or more, the administrator shall make payment to the minor person by paying or
15delivering the money to a broker or financial institution under s. 880.65 (1) (b).
