AB343,1,2 1An Act to amend 46.25 (2m); and to create 46.25 (2p) of the statutes; relating
2to:
disclosure of information to custodial parents.
Analysis by the Legislative Reference Bureau
Under current law, the department of health and social services (DHSS) is
required to administer a state child and spousal support program. The purposes of
the program generally are to establish paternity and to establish, modify and enforce
child and spousal support obligations. DHSS contracts with county boards for
implementation and administration of the program at the local level by child support
agencies. Information that DHSS or a county child support agency obtains in order
to administer the program may be used only in the administration of the program.
This bill provides an exception to the prohibition against use of that information for
any purpose but the administration of the program. Under the bill, DHSS or a county
child support agency may disclose, upon request, to a parent with legal custody of a
child any information possessed by DHSS or the county child support agency about
the child's other parent if that parent has a support obligation to the child or is the
subject of an action to establish such an obligation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB343, s. 1 3Section 1. 46.25 (2m) of the statutes is amended to read:
AB343,2,54 46.25 (2m) The department may request from any person any information it
5determines appropriate and necessary for the administration of this section, ss.
649.19, 49.46, 49.468 and 49.47 and programs carrying out the purposes of 7 USC 2011

1to 2029. Any person in this state shall provide this information within 7 days after
2receiving a request under this subsection. The Except as provided in sub. (2p), the
3department or the county child and spousal support agency may disclose information
4obtained under this subsection only in the administration of this section, ss. 49.19,
549.46 and 49.47 and programs carrying out the purposes of 7 USC 2011 to 2029.
AB343, s. 2 6Section 2. 46.25 (2p) of the statutes is created to read:
AB343,2,117 46.25 (2p) The department or a county child and spousal support agency may
8disclose to a parent with legal custody of a child, upon the parent's request, any
9information possessed by the department or county child and spousal support agency
10about the child's other parent if that other parent owes a support obligation to the
11child or is the subject of an action to establish such a support obligation.
