AB388,1,2 1An Act to create 349.02 (3) of the statutes; relating to: the use of photo radar
2speed detection in the enforcement of state and local traffic laws.

Current law does not limit the use of any type of radar by state and local
authorities in the enforcement of traffic laws relating to speed restrictions. This bill
prohibits the use of photo radar speed detection in the enforcement of speed
restriction laws. Photo radar speed detection is defined as the detection of a vehicle's
speed by use of a radar device combined with photographic identification of the
vehicle.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB388, s. 1 3Section 1. 349.02 (3) of the statutes is created to read:
AB388,1,64 349.02 (3) (a) In this subsection, "photo radar speed detection" means the
5detection of a vehicle's speed by use of a radar device combined with photographic
6identification of the vehicle.
AB388,2,27 (b) Notwithstanding sub. (1), the state and local authorities may not use photo
8radar speed detection to determine compliance with any speed restriction imposed

1by s. 346.57, 346.58, 346.59, 346.595 or 349.11 or a local ordinance in conformity
2therewith.
