AB426,1,2 1An Act to amend 251.03 (1) of the statutes; relating to: the composition of local
2boards of health.

A local board of health is the policy-making body for a local health department.
Under current law, with certain exceptions, a local board of health must consist of
not more than 9 members, at least 3 of whom are not elected officials or employes of
the governing body that establishes the local health department and who have
demonstrated an interest or competence in the field of public health or community
health. Currently, in appointing these members, a good faith effort must be made
to appoint a registered nurse and a physician. Current law also requires that the
members of a local board of health reflect the diversity of the community.
This bill removes the requirement that a local board of health include at least
3 members who are not elected officials or employes of the governing body that
establishes the local health department. Under the bill, the governing body that
establishes the local health department may appoint any number of such persons to
the local board of health. The bill also eliminates the requirement that a good faith
effort be made to appoint a registered nurse and a physician to the local board of
health. Finally, the bill eliminates the requirement that the members of a local board
of health reflect the diversity of the community.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB426, s. 1 3Section 1. 251.03 (1) of the statutes is amended to read:

1251.03 (1) A local board of health shall consist of not more than 9 members.
2At least 3 of these members shall be persons Any member who are is not an elected
3officials official or employes employe of the governing body that establishes the local
4health department and who shall have a demonstrated interest or competence in the
5field of public health or community health. In appointing the members who are not
6elected officials or employes, a good faith effort shall be made to appoint a registered
7nurse and a physician. Members of the local board of health shall reflect the diversity
8of the community.
A county human services board under s. 46.23 (4) may act as a
9county board of health if the membership of the county human services board meets
10the qualifications specified in this subsection and if the county human services board
11is authorized to act in that capacity by the county board of supervisors. If a county
12human services board acts in this capacity, it shall use the word "health" in its title.
AB426, s. 2 13Section 2. Initial applicability.
AB426,2,15 14(1)  Local boards of health; composition. This act first applies to an
15appointment made to a local board of health on the effective date of this subsection.
