AB442,1,2 1An Act to amend 15.04 (1) (h) and 15.04 (1) (j) of the statutes; relating to: the
2use of the term "multiracial" on state forms.

This bill requires the records and forms officer of each state department and
independent agency to review each record and form to determine if that record or
form requires a person who completes the form to identify the race of an individual.
If the record or form does require race identification, the records and forms officer
is required to modify the record or form to include the ability for the race
identification to be "multiracial" for those individuals who wish to indicate that they
have parents of different races.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB442, s. 1 3Section 1. 15.04 (1) (h) of the statutes is amended to read:
AB442,2,54 15.04 (1) (h) Report of forms and papers used. Annually, no later than
5September 1, file with the public records and forms board a report which shall
6include such information relative to records and forms management as may be
7specified by the board. The report shall cover all previously unsubmitted forms and
8papers that were required to be filed with the department or independent agency

1during the preceding fiscal year. The report shall include a listing of all such records
2and forms used by the agency that require the person completing the documents to
3identify the race of an individual and do not include the ability for the race
4identification to be multiracial and the reason why the documents do not include that
5ability.
AB442, s. 2 6Section 2. 15.04 (1) (j) of the statutes is amended to read:
AB442,2,247 15.04 (1) (j) Records and forms officer. Appoint a records and forms officer, who
8shall be responsible for reviewing, consolidating, simplifying, designing and filing all
9records and forms and who may prevent any form from being put into use. The
10records and forms officer shall review each record and form to determine if that
11record or form requires a person who completes the form to identify the race of an
12individual. The records and forms officer shall revise every record and form that
13requires the identification of the race of an individual when the record or form is
14reprinted to include the ability for the race identification to be "multiracial" for those
15individuals who choose to indicate that they have parents of different races. If the
16record or form is electronic, the records and forms officer shall revise the record or
17form immediately to include the ability for the race identification to be "multiracial"
18for those individuals who choose to indicate that they have parents of different races.
19If the record or form includes a listing of specific races to be checked, circled or
20otherwise selected, the term "multiracial" shall be added to the list of races that may
21be selected. Instructions for completing any record or form that requires a person
22who completes the record or form to identify the race of an individual shall inform
23the person that he or she may indicate "multiracial" as his or her choice and that a
24multiracial individual is an individual who has parents of different races.
