AB445,1,3 1An Act to create 350.01 (9m), 350.01 (10c), 350.02 (2) (a) 6. and 350.18 (3) of the
2statutes; relating to: the operation of snowmobiles on the roadways of
3highways for the purposes of personal access.
Analysis by the Legislative Reference Bureau
Under current law, a person may not operate a snowmobile on the roadway of
a highway, street or road except under certain limited circumstances. This bill
specifically authorizes the operation of a snowmobile on a portion of such a roadway
if that portion of the roadway lies within the boundaries of a town, city or village that
has enacted an ordinance that allows the operation of snowmobiles on that portion
for the purposes of personal access. The bill defines personal access as being the
operation of a snowmobile on a roadway for the shortest distance necessary to travel
between a residence or lodging establishment and the nearest snowmobile trail or
route to that residence or lodging establishment.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB445, s. 1 4Section 1. 350.01 (9m) of the statutes is created to read:
AB445,1,65 350.01 (9m) "Lodging establishment" means any of the following that are
6located north of STH 29:
AB445,1,77 1. A bed and breakfast establishment, as defined in s. 254.61 (1).
AB445,1,88 2. A hotel, as defined in s. 254.61 (3).

13. A tourist rooming house, as defined in s. 254.61 (6).
AB445,2,22 4. A campground.
AB445, s. 2 3Section 2. 350.01 (10c) of the statutes is created to read:
AB445,2,84 350.01 (10c) "Personal access" means the operation of a snowmobile on the
5roadway of a highway for the shortest distance that is necessary for the person
6driving the snowmobile to travel safely between a residence or lodging establishment
7and the snowmobile route or snowmobile trail that is closest to that residence or
8lodging establishment.
AB445, s. 3 9Section 3. 350.02 (2) (a) 6. of the statutes is created to read:
AB445,2,1210 350.02 (2) (a) 6. On a portion of the roadway of a highway for purposes of
11personal access if the town, city or village within which that portion of the highway
12lies, enacts an ordinance under s. 350.18 (3) for that portion of the highway.
AB445, s. 4 13Section 4. 350.18 (3) of the statutes is created to read:
AB445,2,1614 350.18 (3) A town, city or village may enact an ordinance allowing the operation
15of snowmobiles, for the purpose of personal access, on a roadway of a highway for any
16portion of a highway that lies within the boundaries of the town, city or village.
