AB446,1,3 1An Act to create 32.035 (3m) and 32.035 (5) (h) of the statutes; relating to: the
2preparation of agricultural impact statements by the department of
3agriculture, trade and consumer protection.

Under current law, the department of agriculture, trade and consumer
protection (DATCP) prepares an agricultural impact statement (AIS) for certain
condemnation projects affecting farm operations. Upon completing the impact
statement, DATCP must distribute it to the governor's office; the senate and
assembly committees on agriculture and transportation; all local and regional units
of government that have jurisdiction over the project; local and regional news media
in the affected area; libraries in the affected area; any individual, group, club or
committee that has demonstrated an interest and has requested receipt of such
information; and the condemnor.
This bill directs DATCP, before preparing an AIS, to notify each owner of
property that may be taken for the project that DATCP may prepare an AIS. The
notice must inform the owner that he or she may submit information to DATCP on
the potential effects of the project. The bill also directs DATCP, upon completing the
impact statement, to distribute it to each owner of property that may be taken for the
project.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

132.035 (3m) Notice to owner. Upon receiving notice from the condemnor
2under sub. (3), the department shall notify each owner of property that may be taken
3for the project that the department may prepare an agricultural impact statement
4for the project. The notice shall inform each owner that he or she may submit
5information to the department on the potential effects of the project.
AB446, s. 2 6Section 2. 32.035 (5) (h) of the statutes is created to read:

AB446, s. 3 8Section 3. Initial applicability.
AB446,2,11 9(1)  This act first applies to projects for which the department of agriculture,
10trade and consumer protection receives notice under section 32.035 (3) of the statutes
11on the effective date of this subsection.
