AB472,1,3 1An Act to renumber 943.20 (2) (a); to amend 943.20 (3) (d) 1. to 4.; and to create
2943.20 (2) (ad) and 943.20 (3) (d) 7. of the statutes; relating to: theft of air bags
3from motor vehicles.
Analysis by the Legislative Reference Bureau
Under current law, the crime of theft typically involves several elements: 1)
intentionally taking property; 2) carrying away, using or doing certain other things
with that property; 3) acting without the owner's consent; and 4) acting with the
intent to deprive the owner permanently of the property. The maximum fine is
$10,000 and the maximum period of imprisonment ranges from 9 months to 10 years
depending on the circumstances surrounding the theft, such as the value of the
property involved. The law provides a 5-year maximum period of imprisonment for
the theft of a firearm, theft from a corpse or theft during a riot or bombing if the value
of the stolen property is $2,500 or less. This bill provides the same 5-year maximum
period of imprisonment for the theft of an air bag from a motor vehicle if the value
of the air bag is $2,500 or less. Thefts involving any property valued at more than
$2,500 remain punishable by a 10-year maximum period of imprisonment under
current law.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB472, s. 2 5Section 2. 943.20 (2) (ad) of the statutes is created to read:

1943.20 (2) (ad) "Air bag" means an inflatable restraint installed in a motor
2vehicle that is designed to protect a driver or other occupant in the event of a crash
3or accident.
AB472, s. 3 4Section 3. 943.20 (3) (d) 1. to 4. of the statutes are amended to read:
AB472,2,55 943.20 (3) (d) 1. The property is a domestic animal ; or.
AB472,2,66 2. The property is taken from the person of another or from a corpse ; or.
AB472,2,87 3. The property is taken from a building which has been destroyed or left
8unoccupied because of physical disaster, riot, bombing or the proximity of battle; or.
AB472,2,109 4. The property is taken after physical disaster, riot, bombing or the proximity
10of battle has necessitated its removal from a building; or.
AB472, s. 4 11Section 4. 943.20 (3) (d) 7. of the statutes is created to read:
AB472,2,1212 943.20 (3) (d) 7. The property is an air bag taken from a motor vehicle.
AB472, s. 5 13Section 5. Initial applicability.
AB472,2,1514 (1) This act first applies to offenses committed on the effective date of this
