AB561,1,3 1An Act to amend 13.92 (1) (b) (intro.); and to create 13.123 (4) of the statutes;
2relating to: drafts received by members of the legislature and office expenses
3authorized for members of the legislature.
Analysis by the Legislative Reference Bureau
Currently, the legislative reference bureau is directed by law to provide drafting
services equally and impartially to the limits of its facilities and staff. Under joint
rule 51, any member or committee of the legislature, the chief clerk of either house
or any state agency may enter an unlimited number of drafting requests without
charge.
Currently, a sum sufficient appropriation is provided for the operation of the
senate and assembly. The statutes do not specifically treat the use of the
appropriation for the cost of operating legislative offices.
This bill limits the number of free drafts that a member of the legislature may
enter individually to 20 per legislative session. This number includes drafts for bills,
joint resolutions and resolutions only.
The bill also specifically empowers the joint committee on legislative
organization or the committee on organization of either house of the legislature to
provide an allowance for the office expenses of each member of the legislature.
The bill provides that any member of the legislature who receives drafts from
the legislative reference bureau exceeding 20 per legislative session shall pay $50 for
each draft received by the member exceeding 20 per legislative session. If an
allowance for office expenses is provided, the member must make the payment from
that allowance.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB561, s. 1 1Section 1. 13.123 (4) of the statutes is created to read:
AB561,2,42 13.123 (4) Office expenses. The joint committee on legislative organization or
3the committee on organization of either house of the legislature may provide an
4allowance for each member of the legislature to utilize for office expenses.
AB561, s. 2 5Section 2. 13.92 (1) (b) (intro.) of the statutes is amended to read:
AB561,2,136 13.92 (1) (b) Drafting section. (intro.) The legislative reference bureau shall
7provide drafting services equally and impartially and to the limits of its facilities and
8staff. If any member of the legislature receives drafts for bills, joint resolutions and
9resolutions exceeding 20 per legislative session, the bureau shall charge the member
10$50 for each draft received exceeding 20. If an allowance is provided under s. 13.123
11(4), the cost shall be paid from that allowance. The bureau shall deposit all receipts
12under this paragraph as general purpose revenue-earned.
