AB568,1,2 1An Act to amend 940.22 (2) of the statutes; relating to: sexual exploitation by
2a therapist and providing a penalty.
Analysis by the Legislative Reference Bureau
Current law prohibits a therapist, or a person who purports to be a therapist,
from having sexual contact with any of his or her patients or clients. Upon
conviction, a violator may be fined not more than $10,000 or imprisoned for not more
than 5 years or both. This bill increases the maximum period of imprisonment for
the violation from 5 years to 10 years.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB568, s. 1 3Section 1. 940.22 (2) of the statutes is amended to read:
AB568,1,94 940.22 (2) Sexual contact prohibited. Any person who is or who holds himself
5or herself out to be a therapist and who intentionally has sexual contact with a
6patient or client during any ongoing therapist-patient or therapist-client
7relationship, regardless of whether it occurs during any treatment, consultation,
8interview or examination, is guilty of a Class D C felony. Consent is not an issue in
9an action under this subsection.
