1995 - 1996 LEGISLATURE
November 3, 1995 - Introduced by Representative Schneiders. Referred to
Committee on State Affairs.
AB653,1,2 1An Act to amend 563.935 (6) of the statutes; relating to: requirements for
2claiming a prize at a raffle conducted under a Class B license.
Analysis by the Legislative Reference Bureau
Under current law, the gaming commission may issue a Class A license for the
conduct of a raffle in which some or all of the tickets for that raffle are sold on days
other than the same day as the raffle drawing and a Class B license for the conduct
of a raffle in which all of the tickets for that raffle are sold on the same day as the
raffle drawing. Among the requirements for the conduct of a Class B raffle is a
requirement that the purchaser of a raffle ticket need not be present at the drawing
to claim a raffle prize.
This bill provides that the purchaser of a ticket must be present at a Class B
raffle drawing to win a prize, unless the purchaser gives the ticket to another person
who may claim the prize on behalf of the purchaser, but only if that other person is
present at the drawing. The bill also provides that if a purchaser of a ticket must
leave before the drawing the purchaser may request and receive a refund in the
amount of the price of the ticket. The seller of the ticket is required immediately to
void that ticket.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB653, s. 1 3Section 1. 563.935 (6) of the statutes, as created by 1995 Wisconsin Act 27, is
4amended to read:
AB653,2,95 563.935 (6) The purchaser of a ticket must be present at the drawing to win a
6prize, unless the purchaser gives the ticket to another person who
may claim the

1prize on behalf of the purchaser, but only if that other person is present at the
2drawing. If the purchaser of the ticket gives the ticket to another person to claim a
3prize on behalf of the purchaser, the organization conducting the raffle and the
4commission shall not be held responsible or liable in any dispute regarding the
5ownership of the ticket. If a
purchaser of a ticket must leave before the drawing, the
6purchaser, in lieu of giving the ticket to another person, may request and receive a
7refund in the amount of the price of the ticket, but only if the purchaser makes the
8request before the drawing. The seller of the ticket shall immediately void that
9ticket
