AB700,1,2 1An Act to create 347.483 of the statutes; relating to: prohibiting the use and
2sale of radar detectors for motor vehicles.

This bill prohibits a motorist from operating a motor vehicle equipped with a
device for detecting or interfering with electronic devices used by law enforcement
officers to detect the speed of motor vehicles (radar detector). The presence of an
operative radar detector in a motor vehicle creates a presumption of a violation. The
bill also prohibits any person from selling a radar detector or offering a radar detector
for sale in this state. The bill contains an exception for the transportation of
inoperative radar detectors. The penalty for violating these prohibitions is a
forfeiture of not more than $200.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB700, s. 1 3Section 1. 347.483 of the statutes is created to read:
AB700,1,7 4347.483 Radar detectors. (1) Definitions. (a) "Radar detection jamming
5device" means a device that emits radiation for the purpose of interfering with,
6diffusing or preventing the clear reception of emitted signals of a speed measuring
7device used by law enforcement officers to measure the speed of motor vehicles.

1(b) "Radar detector" means a device or mechanism which detects the emission
2of radiation in the portion of the electromagnetic spectrum used by law enforcement
3officers to measure the speed of motor vehicles.
AB700,2,7 4(2) Use prohibited. No person may operate upon a highway a motor vehicle
5equipped with a radar detector or a radar detection jamming device. The presence
6of any radar detector or radar detection jamming device in or upon a motor vehicle
7upon a highway constitutes prima facie evidence of a violation of this subsection.
AB700,2,9 8(3) Sale prohibited. No person may sell or offer for sale in this state any radar
9detector or radar detection jamming device.
AB700,2,10 10(4) Exceptions. This section does not apply to:
AB700,2,1311 (a) Any receiver of emitted radiation used or to be used for lawful purposes to
12receive a signal from any frequency licensed by any federal agency or agency of this
13state.
AB700,2,1514 (b) Any radar detector or radar detection jamming device used or to be used by
15law enforcement agencies in their official duties.
AB700,2,1816 (c) The transportation of a radar detector or radar detection jamming device
17for use or sale if the device is stored in an enclosed storage compartment of the vehicle
18and the device is inoperative during transport.
AB700, s. 2 19Section 2. Effective date.
AB700,2,21 20(1) This act takes effect on the first day of the 6th month beginning after
21publication.
