AB716,1,3 1An Act to amend 59.23 (11); and to create 20.505 (1) (cm) of the statutes;
2relating to: reimbursement to counties for water rescue and recovery services
3and making an appropriation.

Under current law, if a sheriff is directed to do so by the county board, he or she
is required to conduct operations in county waters for the rescue of human beings and
for the recovery of human bodies. Under this bill, the department of administration
is required to reimburse counties for the costs incurred in conducting these water
rescue and recovery operations.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB716, s. 1 4Section 1. 20.505 (1) (cm) of the statutes is created to read:
AB716,1,65 20.505 (1) (cm) Water rescue reimbursements. A sum sufficient to make the
6payments to counties under s. 59.23 (11).
AB716, s. 2 7Section 2. 59.23 (11) of the statutes is amended to read:
AB716,2,68 59.23 (11) Conduct operations within the county and, when the county board
9so provides, in waters of which the county has jurisdiction under s. 2.04 for the rescue

1of human beings and for the recovery of human bodies. If a sheriff's department
2incurs costs for the water rescue of human beings or for the recovery from water of
3human bodies, the department of administration shall reimburse the county, from
4the appropriation under s. 20.505 (1) (cm), for the costs if the sheriff submits written
5evidence of the costs incurred in a form that is acceptable to the department of
6administration.

AB716,2,9 8(1) This act first applies to a water rescue of a human being or the recovery from
9water of a human body on the effective date of this subsection.
