AB754,1,3 1An Act to repeal 346.07 (1); and to amend 346.17 (1) of the statutes; relating

the requirement of giving audible signal prior to overtaking vehicles to the

Analysis by the Legislative Reference Bureau
Under current law, the driver of a motor vehicle is required to sound the
vehicle's horn before attempting to overtake and pass to the left of a vehicle traveling
in the same direction. This requirement does not apply within business or residence
districts, or on any highway having more than one lane available for traffic in the
same direction unless such an audible warning is reasonably necessary to warn the
vehicle about to be passed.
This bill eliminates this requirement.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB754, s. 1 4Section 1. 346.07 (1) of the statutes is repealed.
AB754, s. 2 5Section 2. 346.17 (1) of the statutes is amended to read:
AB754,1,96 346.17 (1)  Except as provided in sub. (5), any person violating s. 346.04 (1) or
7(2), 346.06, 346.07 (1), 346.12 or 346.13 (1) or (3) may be required to forfeit not less
8than $20 nor more than $40 for the first offense and not less than $50 nor more than
9$100 for the 2nd or subsequent conviction within a year.
