AB778,1,2 1An Act to amend 36.27 (1) (a); and to create 36.27 (1) (b) of the statutes;
2relating to: segregated university fees at the University of Wisconsin System.
Analysis by the Legislative Reference Bureau
Under current law, the University of Wisconsin (UW) System charges students
a fee, in addition to instructional fees, for various services, programs and facilities.
The students of each campus, represented by their student governments, are
responsible for the disposition of those segregated university fees that constitute
substantial support for campus student activities.
This bill authorizes the board of regents to charge a fee to fund debt service on
obligations issued before the bill's effective date and to fund costs that are directly
related to the maintenance of any student union facility. The bill provides that any
other fee for the support of noninstructional student activities is optional, and
prohibits the board from engaging in negative option billing to collect it.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB778, s. 1 3Section 1. 36.27 (1) (a) of the statutes is amended to read:
AB778,2,34 36.27 (1) (a) Subject to par. pars. (b) and (c), the board may establish for
5different classes of students differing tuition and fees incidental to enrollment in
6educational programs or use of facilities in the system. Except as otherwise provided
7in this section, the board may charge any student who is not exempted by this section

1a nonresident tuition. The board may establish special rates of tuition and fees for
2the extension and summer sessions and such other studies or courses of instruction
3as the board deems advisable.
AB778, s. 2 4Section 2. 36.27 (1) (b) of the statutes is created to read:
AB778,2,85 36.27 (1) (b) 1. The board may charge students a fee to fund debt service on
6obligations issued prior to the effective date of this subdivision .... [revisor inserts
7date], and to fund costs that are directly related to the maintenance of any student
8union facility.
AB778,2,169 2. Any fee for the support of noninstructional student activities that is in
10addition to the fee under subd. 1. is an optional fee. Any form that allows a student
11or a student's parent or guardian to indicate his or her intent regarding paying the
12fee shall state, in at least 8-point type, that the fee is optional and shall require the
13student or the student's parent or guardian who wishes to pay the fee to affirmatively
14indicate that intent. The board may not engage in negative option billing to collect
15the fee. This subdivision does not prohibit any center or institution from charging
16a fee for room or board or both.
AB778, s. 3 17Section 3. Initial applicability.
AB778,2,19 18(1)  This act first applies to fees charged for the first fall semester beginning
19after publication.
