The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Prefatory note: This bill was prepared for the joint legislative council's special
committee on school health services.
Current law limits the increase in the total amount of revenue that a school district
may receive from general school aids and property taxes. In the 1995-96 school year, the
maximum allowable increase per pupil is $200. In each school year thereafter, the
maximum allowable increase per pupil is $206. The limit is based on the difference
between the average of the number of pupils enrolled in the 3 previous school years and
the average of the number of pupils enrolled in the current and 2 preceding school years.
This bill increases the school district's revenue limit in any school year by the
amount spent by the school district in the previous school year for costs associated with
providing noneducational services to medically fragile pupils that are not reimbursed.
Under the bill, the department of public instruction would determine the amount of the
revenue limit increase and would be required to define by administrative rule the term
"medically fragile".
The bill would initially apply to the school district's revenue limit for the 1996-97
school year.

1121.91 (4) (f) The limit otherwise applicable to a school district's revenue under
2sub. (2m) in any school year is increased by an amount equal to the amount spent by
3the school district in the previous school year for costs associated with providing
4noneducational services to medically fragile pupils that are not reimbursed, as
5determined by the department. The department shall promulgate rules defining
6"medically fragile" for the purpose of this paragraph.
