AB795,1,3 An Act to create 349.02 (3) of the statutes; relating to: requiring motor vehicles being used to enforce state or local traffic laws to display Wisconsin registration plates.

Analysis by the Legislative Reference Bureau

This bill provides that any motor vehicle that is being used by a law enforcement officer or motor vehicle inspector to enforce any state or local traffic law must be displaying Wisconsin registration plates. This requirement does not apply if the vehicle is being used in drug-related law enforcement activities, an undercover investigation and operation, or in an emergency situation.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB795, s. 1 Section 1. 349.02 (3) of the statutes is created to read:

AB795,1,10 349.02 (3) Notwithstanding sub. (1), a police officer, sheriff, deputy sheriff, traffic officer or motor vehicle inspector may not use a motor vehicle to enforce any of the state traffic laws or any local ordinance enacted under this chapter unless the vehicle is displaying Wisconsin registration plates. This subsection does not apply if the vehicle is being used in drug-related law enforcement activities, an undercover investigation and operation, or in a case made necessary by an emergency situation.

AB795, s. 2 Section 2. Initial applicability.

AB795,2,3 (1) This act first applies to the enforcement of state and local traffic laws on the effective date of this subsection.
